What We Collect

Personal Information. Personal Information is information that personally identifies you, such as your name, email address or billing information, or other data that we can reasonably link to that kind of information. We do not collect Personal Information on this site unless you choose to give it to us, for example by registering to receive updates or newsletters.

Log Data. Like all web sites, we automatically log the Internet page request that gets you to our web site. This typically includes the referring URL 1, the URL of the page requested, Internet Protocol address 2, information about your Internet service provider or your domain name 3, information about your browser and browser language, (Firefox, Safari, Explorer, etc.), your operating system (e.g., Windows, OSX, etc.), the date and time of your request, and one or more cookies 4 that may uniquely identify your browser. We also log information about how you use our website, including the pages you visit, the applications you use, information you enter into forms on the web site. This information does not identify you to us unless you have given us your name, contact information, or other Personal Information.

How We Use and Disclose that Information

Any Personal Information you submit is stored securely and used to respond to your requests, process transactions you initiate., or used by the City of New York for Governmental Purposes. 5

We use Log Data to respond to your requests, improve the content and usability of this website, identify site performance needs; to ensure compatibility with the technology you use, and to our services in general. In order to accomplish those goals, from time to time, we may conduct statistical analysis of the data it collects.

We may disclose that information to third parties to help us in these activities, but we do not allow them to use the Personal Information for purposes other than those for purposes requested by you (e.g. receive Newsletter). We do not we do not sell, exchange or otherwise distribute the data collected for commercial or marketing purposes. 6

We use cookies on this site to distinguish among our visitors and track information during multiple visits. "Temporary cookies" 7 expire at the end of your browsing session. If we send electronic mail ("e-mail") to a user, such e-mail is NOT confidential 10 and is identical in nature to that information generally available to the public and news media.

Security

In certain instances, you may have the opportunity to receive or create a password to access or submit personally identifiable information. You should not divulge a password to anyone, and we will never ask for a password in a telephone call, fax, e-mail or other form of unsolicited communication. When you finish using a password protected application, you should exit the relevant page(s), and close the browser entirely if you are using a publicly-accessible browser.

We have implemented technical, administrative, and physical safeguards designed to protect your information from unauthorized access, use, or alteration.

Children

We do not knowingly collect or solicit information from minors or seek to determine whether avisitor is a minor. Consequently, because such information will not be specifically identified as being from minors, you should be aware that personally identifiable information submitted by minors will be subject to being treated in the same manner as information given by an adult and may become subject to FOIL.

We strongly believe that parental supervision is an important factor in Internet use by minors and ask parents to guide their minor children when children are asked to provide any personal information online. If you are a child, please don't submit personal information on this site.

We may change this policy from time to time, and reserve the right to do so without notice.

  1. This refers to the Uniform Resource Locator ("URL") of the site that you visited prior to coming to our site, unless you connect directly to our site or use it as a homepage or "portal."
  2. We collect the apparent Internet Protocol ("IP") address of your Internet Service Provider ("ISP") and/or your computer, if your computer has an IP address assigned directly to it. Domain Name is an alphanumeric value that represents the plain language (English or such other local language as is relevant) translation of the IP address assigned to a specific user or collection of users. For example, if a user had an IP address of 123.123.123.123, the Domain Name that represented that address might be WWW.HOME.COM.
  4. Cookies are text files, or entries in larger files, utilized to distinguish between visitors to a website, and to track information during multiple visits to a website. The use of cookies is a standard practice among Internet websites. Most Internet web browsers may be customized to reject cookies, to only accept or reject cookies by user intervention, or to delete cookies. Rejecting and/or removing cookies, however, may lead to loss of functionality on those pages requiring cookies to function fully. Additionally, if a user has created a customized version of the site, we create a cookie that contains the user's unique identifier and indicator for any custom content modules requested and, if a user elected the "remember me" option for signing in to site, the cookie will contain a user's password. Deletion of such a cookie could result in the loss of one's customized site settings.
  5. Affirmatively submitted information is stored in a secure environment, and will be used by the City of New York in furtherance of its duties and/or obligations to its citizenry. If you affirmatively submit information on this site by, among other means, sending an electronic mail ("e-mail"), filling in and submitting an on-line form, or personalizing this site as a customized portal, this information may be used by the City of New York for governmental purposes including, without limitation:
    1. Helping the City respond to a request for information not readily available on this site;
    2. Investigating a problem reported on this site;
    3. Keeping lists of parties interested in some particular issue or facet of New York City life about which the City anticipates issuing further information in the future;
    4. Disclosure of such information pursuant to a request made under Freedom of Information Law ("FOIL") or court order, if such information is not protected by federal or state law.
    The material you submit may be seen by various people employed by the City of New York. We may enter the information you send into our electronic database, to share with our attorneys and investigators involved in law enforcement or public policy development. We may also share it with a variety of other government agencies enforcing consumer protection, competition, and other laws. You may be contacted by any of those agencies.
  6. Commercial and non-commercial marketing purposes include, for the purposes of this policy, Unsolicited Commercial Electronic Mail (colloquially known as "SPAM" e-mail), targeted e-mail for the purpose of selling products, or the sale or exchange of personally identifiable information between parties that anticipate receiving value in exchange for such information.

A web bug is a clear, camouflaged or otherwise invisible graphics image format ("GIF") file placed upon a web page or in hyper text markup language ("HTML") e-mail and used to monitor who is reading a web page or the relevant email. Web bugs can also be used for other monitoring purposes such a profiling of the affected party.   10. Pursuant to Article 6 of NYS Public Officers Law 87, certain categories of information may be exempt from such disclosure under FOIL including, but not limited to, records whose disclosure would constitute an unwarranted invasion of personal privacy under 89(2) of Article 6, or might endanger the life or safety of any person.
  11. E-mail is generally not secure against interception. If a communication is very sensitive, or includes personal information like a bank account, charge card, or social security number, it is more prudent to send such communication by postal mail (i.e., "snailmail") instead.

.NYC BEST OF BOROUGHS CONTEST RULES AND REGULATIONS

The .nyc Best of the Boroughs Contest ("Contest") is an initiative of Registry Services, LLC, a Neustar company, the registry services provider of the .nyc top level domain, ("Sponsor") designed to showcase websites in the .nyc top level domain. Winners will be promoted through campaigns and initiatives of the .nyc TLD. Sponsor is the sole operator of this Contest, is responsible for all judging decisions and fulfillment of all prizes. For clarity, the City of New York is not a sponsor of the Contest, is not operating the Contest, and is not responsible for the judging decisions or fulfillment of any prizes.

Official Rules:

1. The Basics
The Contest will begin at 12:01 AM Eastern Standard Time ("EST") September 04, 2018 and end at 11:59 PM EST on September 19, 2018 ("Contest Period"). Participation is subject to all federal, state and local laws and regulations. Void where prohibited or restricted by law. You are responsible for checking applicable laws in your jurisdiction before participating in the Contest to make sure that your participation is legal and to ensure that you comply with all relevant laws.

2. Eligibility
The Contest is open only to .nyc registrants with a valid .nyc web address in use prior to 09/03/18 at 11:59 PM EST. Employees of Sponsors, the City of New York, the judges or any of their respective affiliates, subsidiaries, or any other company or individual involved with the design, production execution or distribution of the Contest or the immediate family (spouse, parents and step-parents, sibling and step-siblings, and children and stepchildren) or household member(s) (people who share the same residence at least three (3) months out of the year) of each such employee, are not eligible to participate. In order to participate, you must agree to the accompanying terms. Participation constitutes participant's full and unconditional agreement to these Official Rules, including the accompanying Participant Agreement ("Agreement"), and Sponsor's decisions resulting from the Agreement, which are final and binding in all matters related to the Contest.

Entrants must have a physical address in the borough from which your entry is submitted. No more than three (3) entries per registrant. Each entry must be for a unique .nyc registered website.

3. How to Enter
A. No purchase is necessary to enter this Contest. To enter the .NYC Best of Boroughs Contest, you may submit your entry to the Sponsor electronically at the below listed website. The instructions contained on the website detail requirements and contest process: www.BestOf.nyc

B. Entries must be submitted after 12:01 a.m. on September 04, 2018 and before 11:59 p.m. on September 19, 2018. Electronic submissions will be deemed submitted at the time received. The inclusion of any false, deceptive, and/or obscene images or words in an entry will render the entry ineligible. All entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of these rules and regulations shall be disqualified.

C. Up to three (3) different entries per entrant are allowed but each entry must be for a unique web address at .nyc with unique website content to be eligible for consideration. An entrant with multiple entries that are ineligible entries submitted subsequent to the first three eligible entries will be disqualified.

D. If, for any reason, the internet entry portion of the Contest is not capable of operating as planned, including, without limitation, malfunction of any telephone networks, lines, and/or computer online systems, Sponsor will not be liable for any damages resulting from such events. Sponsor is not responsible for failures in the receipt of any entry, whether due to human error or internet or network traffic congestion or for any injury or damage to any computer related to the participation or downloading of any materials in connection with this Contest, and is not responsible for the security of any computer through which submission of an entry is attempted or completed, including any infections by computer virus, bugs, tampering, unauthorized intervention, fraud, or technical failures of any kind, or any other causes. Sponsor reserves the right, at its sole discretion, to disqualify any entry by an individual who tampers directly or indirectly with the Contest process, and to cancel, modify, or suspend the Contest. Sponsor assumes no responsibility for any error, deletion, defect or delay in operation or transmission, communication failure, theft, destruction or unauthorized access to, or alteration of, the entries that is beyond the reasonable control of Sponsor and which may corrupt or affect the fairness, integrity, security or administration of this Contest. If there is any dispute as to the identity of an entrant, the decision of Sponsor may disqualify the entry unless the dispute is resolved by the purported entrant(s) to the satisfaction of Sponsor.

4. Public Voting

A. Contest opens and submissions will be accepted starting September 04, 2018 at 12:01 a.m. EST and will remain open until September 19, 2018 at 11:59 p.m EST. After submission closes for all entries, entries will be displayed in an online gallery at www.BOB.nyc. Once the application period closes and entries are visible, a public voting period will commence starting on September 20, 2018 at 12:01 a.m. EST and remain open through September 25, 2018 at 11:59 p.m EST. New York City residents will be encouraged to vote for their favorite Contest entry during the public voting period. Voters must provide valid New York City residential zip code information to confirm eligibility to vote in the Contest.

B. Judging criteria:
After the public voting period, all submissions will be reviewed by the Sponsor Registry team to select no more than five finalists to advance to the next judging stage which will consist of a judging panel review ("Judges"). The final selection of borough winners will be determined by the Judges who are persons with a local interest in the advancement of the local New York City economy. Judges of the 2018 Best of Boroughs contest are: Dirk McCall, Director of External Affairs, Office of the Bronx Borough President Ruben Diaz, Jr., Eugene Resnick, Deputy Communications Director & LGBT Liaison, Office of Brooklyn Borough President Eric L. Adams, Gale Brewer, Manhattan Borough President, Sharon Lee, Director of Communications, Office of Queens Borough President Melinda Katz, Jennifer Sammartino, Director of Tourism and Cultural Affairs, Staten Island, Alby Bocanegra, interim CTO, Noel Hidalgo Executive Director, betaNYC, Gary Johnson, Director of Strategy and Operations, NYCx, Mayor's Office of the Chief Technology Officer. Judging criteria will be based on general public appeal, which will take into account the number of votes for each business received during the open public voting period, the value to local community and economy, the history and story of the individual entrant as it relates to the greater good of the New York City community, and the overall user experience of the .nyc website, to include but not be limited to, visual aesthetics, content, functionality, structure and navigation of the website. The odds of winning will depend on the number of eligible entries received. If any judge is unable to participate, the remaining judges will select the winners.

Phase I (Selection of Five Finalist Entries per Borough): The preliminary finalist selection will be made by the Sponsor Registry team based on general public appeal, as determined through the open public voting period, the individual entrants' value to local community and economy, as described in the narrative story submitted by the entrant, as well as the overall experience of the .nyc website, to include but not be limited to the visual design, content, functionality, structure, navigation, interactivity and overall website experience. These considerations will be used by Sponsor to identify the top five entrants in each borough.

Phase II (Selection of Five Winners): The final selection of one winner per borough will advance to the judging panel based on evaluation of the following four factors: public voting, quality of website, contribution to the NYC community, and passion behind the entrants' history.

a. Overall experience of the .nyc website:

Content - Is information provided on the site? Content should be relevant, and appropriate for the audience. Good content will be informative and useful.
Structure and Navigation - Is it easy and intuitive to navigate the website? Good navigation gets you where you want to go quickly and offers easy access to the breadth and depth of the site’s content.
Visual Aesthetic - This is the appearance of the site. It's more than just a pretty homepage, and it doesn't have to be cutting edge or trendy. Good visual aesthetics are quality, appropriate, and relevant images and messaging for the audience.
Functionality - Good functionality means the site works well. It loads quickly and is relevant for the intended audience and purpose of the business.

Examples of going above and beyond for users, relevant community, customers and clients

5. Winner Selection
On October 03, 2018, upon initial review of the applications by the Sponsor, a notification will be sent to the five finalists in each borough at the email address provided by the entrant, notifying each of advancement to the Phase II judging stage and requesting authorization and approval for potential promotional use of the website and identity of the entrant in various campaigns and initiatives by the .nyc TLD. The five final winners, one from each borough, will be announced to the public on October 17, 2018.

A. Notification and Verification of Eligibility

In order to be eligible to be declared a Best of Borough winner, within two business days after entrant's notification that the entrant's Contest has been selected as a finalist, the entrants selected by Sponsor must complete and, either the entrant, or if the entrant is a minor, then the parent or legal guardian on behalf of such minor entrant, must sign a Contest eligibility and liability/advertising release and indemnification in the form required by Sponsor, confirming his or her compliance with these rules and regulations and releasing the Sponsor, judges, the City of New York and its employees, and all persons involved with the Contest of all liability.

If, after selection as a finalist, an entrant is not eligible or cannot be contacted by Sponsor within the two business days following selection, the Contest selection panel may select a replacement entrant, and Sponsor and the members of the selection panel shall be released and discharged from any liability or responsibility for such substitute selection.

No notice of the selections made will be given to any other entrants other than posting of finalists and winners on the Contest website. By entering this Contest, the entrants agree to abide by these rules and regulations and agree that the decisions of Sponsor and its selection panel and the judges are final.

6. Prize
The goal of this Contest is to celebrate the use of the .nyc TLD, and inspire local discovery of people, non-profits, companies and others using the .nyc TLD. To further that mission, one winner from each of the five boroughs will be awarded $5,000 and featured in future marketing efforts for the .nyc TLD. The use of a general public website vote in the Contest is to gauge public interest in the individual entrants' approach to using the .nyc gTLD and to educate New Yorkers with the understanding that .nyc web addresses are available and in use throughout the five boroughs.

7. Use of Entry
Entrant (or entrant's parent/legal guardian on behalf of entrant, as applicable) agree and acknowledge that upon submission of the entry, and thereafter, Sponsor is free to utilize the entry in any format, medium and media for any purpose. Entrant will be required to provide a license to Sponsor to use the entry in secondary works for all purposes, including advertisements or program publicity before being selected as a winner by the selection panel.

8. Information Provided
The submission of an entry constitutes each entrant's permission to print and/or post the entrant's name, .nyc TLD, affiliation, and/or brand in all mediums, media and formats, and permission by each of the winners to the use of his/her name, photograph, and/or voice recordings and likenesses for advertising and program publicity purposes, in all media without compensation or additional permission, except where prohibited by law.

9. Reservation of Rights
Sponsor reserves the right to withdraw, amend or terminate this Contest at any time without notice. Neither Sponsor nor the City of New York are responsible for any damage, loss, inconvenience, or injury suffered by anyone due to the results, termination, discontinuance, or modification of this Contest. Neither Sponsor nor the City of New York are liable for any errors or omissions or negligence that may arise out of, or in connection with, the Contest. Neither Sponsor nor the City of New York are liable for injuries, death, damages, or losses of any kind resulting from acceptance of winner status and publicity arising out of or in connection with this Contest.

10. Applicable Laws
This Contest is subject to all applicable federal, state and municipal laws and regulations and is void where prohibited. This Contest shall be governed by and construed in accordance with the laws of the State of New York, and the venue for all controversies shall be located exclusively in the City and State of New York.

11. Release of Liability
All persons submitting, or attempting to submit, entries for consideration in the Contest, and entrants, including Winners, hereby release Sponsor, the City of New York, the judges and their respective employees, partners, affiliates, advertising contractors and consultants from any and all liability, including personal injury, death, damages, monetary losses, risks of travel, and/or attendance at, public events, arising as a result of, or otherwise related to, their participation in the Contest for .nyc TLD media campaigns and any disqualification or omission from participation in the Contest, however arising.
